Terms of Service

1. Eligibility and minors

You must be at least 13 years old to use the Service. By using the Service you represent that the information you provide is accurate and kept up to date.

If you are under 18, you may use the Service only with the involvement of a parent or guardian, who agrees to these Terms on your behalf and is responsible for any payments made through your account. Any payment card you use must belong to you or be used with the cardholder's permission.

2. The Service

Nomad AI Systems provides Nomad Journal and related tools for personal trade journaling, analytics, strategies and rules tracking, CSV import from supported broker/prop exports, optional AI-assisted analysis (including analytics chat and Nomad process grades with ICT chart reads on tagged setups), Games / practice modes, and Backtesting (Beta) historical chart practice. The Service is provided for informational, journaling, educational, and practice purposes only. It is not financial, investment, tax, medical, or legal advice, and we are not a broker, financial adviser, or financial product issuer.

Free accounts include dashboard access, manual trade entry, and CSV import, limited to 20 trades per month. Pro unlocks unlimited trades, analytics and reports, Nomad process grades (including ICT chart analysis on eligible trades), strategies and rules, AI features, Games, and Backtesting (Beta). Feature availability may change as we improve the Service.

3. Accounts and security

You are responsible for safeguarding your login credentials and for all activity under your account. Do not share your account or credentials. Notify us promptly at support@nomadsys.tech if you suspect unauthorised access. You may close your account at any time by requesting deletion via privacy@nomadsys.tech (see Your Data Rights).

You agree not to attempt to circumvent authentication, expose or harvest other users’ data, or probe the Service for vulnerabilities except through coordinated disclosure to privacy@nomadsys.tech. Our security practices are summarised at /security.

4. Subscriptions, billing and renewals

Free accounts include a limited number of trades per month. Pro subscriptions are billed at $19.99 AUD/month through our payment processor, Stripe. Paid subscriptions automatically renew each billing period until cancelled. You authorise us (via Stripe) to charge your payment method for each renewal at the then-current price.

You can cancel at any time from Account → Manage billing. Cancellation stops future renewals; you keep Pro access until the end of the current paid period. Prices may change with notice; changes apply from your next renewal. Billing questions: billing@nomadsys.tech.

5. Refunds and consumer rights

Except where required by law or stated below, subscription fees are non-refundable and there are no refunds for partial billing periods.

Minors' card use. If a paid subscription was purchased by a person under 18using a payment card that was not their own and without the cardholder's (for example a parent's or guardian's) consent, we will, on request and reasonable verification, refund up to the most recent 3 months of subscription fees. This does not apply where a person used their own payment card.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or other laws that cannot lawfully be excluded. Where our liability for failing to meet a consumer guarantee can be limited, it is limited to resupplying the Service or paying the cost of resupply.

6. Your content

You retain ownership of the trade data, notes, screenshots, and CSV exports you upload ("Your Content"). You grant us a limited, non-exclusive licence to host, process, and display Your Content solely to operate and improve the Service for you, including sending relevant content to our AI subprocessors to deliver Pro analysis features. You are responsible for ensuring you have the right to upload Your Content and that it does not include unlawful material or other people's personal information without a lawful basis.

7. Acceptable use

You agree not to:

• attempt to gain unauthorised access to the Service or other accounts;
• probe, scan, or test vulnerability of our systems except via coordinated disclosure to privacy@nomadsys.tech;
• interfere with or disrupt the Service;
• scrape or harvest data (including market data obtained through the Service) for redistribution;
• reverse engineer the Service except to the extent permitted by law;
• resell or sublicense the Service or redistributed market data;
• abuse rate limits or automated access in a way that harms the Service or our providers;
• upload malware, or attempt to exfiltrate secrets, API keys, or other users' data;
• post or request that we publish fake reviews, fabricated testimonials, or misleading endorsements;
• use the Service for any unlawful, infringing, or abusive purpose.

We may suspend or terminate accounts that breach these Terms.

8. Intellectual property

The Service, including its software, design, branding, and content (excluding Your Content), is owned by Nomad AI Systems or its licensors and is protected by intellectual property laws. We grant you a personal, non-transferable, non-exclusive right to use the Service in accordance with these Terms. All other rights are reserved. Third-party names and trademarks are the property of their respective owners.

9. AI features, backtesting, games, and trading risk

AI-generated analysis, summaries, process grades (including objective ICT-style chart reads on trades you tag or describe as ICT-based), and detected values may be inaccurate, incomplete, or out of date, and must not be relied on as advice. CSV imports translate broker/prop exports into journal trades and may estimate missing fields (for example stop or target); you should review imported trades before relying on them.

Backtesting (Beta), Games, and related chart features use historical market data licensed from third-party providers. Data may be delayed, incomplete, adjusted, or incorrect. Chart drawings, practice trades, simulated orders, and game rounds are for education and practice only — they are not live market orders and do not execute on any exchange or broker. Simulated or practice results do not guarantee future trading performance. Chart drawings and related preferences may be stored in your browser's local storage; beta features may change, lose data, or be discontinued at any time.

Economic news calendar content is sourced from Forex Factory and, for some historical days, archived pages via the Internet Archive. That calendar is informational only — not investment advice — and may be incomplete, delayed, mistimed across time zones, or unavailable. Forex Factory and related marks belong to their respective owners; Nomad is not affiliated with or endorsed by Forex Factory.

Trading and investing involve substantial risk of loss and are not suitable for everyone. Past performance and any metrics shown in the Service are not indicative of future results. You are solely responsible for your trading and financial decisions.

10. Honesty in marketing

We strive to describe the Service accurately. We do not authorise fake reviews or fabricated performance claims. If you believe a public statement about Nomad is misleading, contact support@nomadsys.tech.

11. Third-party services

The Service relies on third parties (for example hosting, database, email, payment, AI, analytics, and market-data providers). We are not responsible for the availability, acts, or omissions of those third parties. Your use of certain features may also be subject to their terms. 12. Warranty disclaimer

To the maximum extent permitted by law, and subject to any rights you have under the Australian Consumer Law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted or error-free operation.

13. Limitation of liability

To the maximum extent permitted by law, Nomad AI Systems will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, trading losses, data, or goodwill, arising from or related to your use of the Service. To the extent our liability cannot be excluded but can be limited, our total aggregate liability is limited to the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

14. Indemnity

You agree to indemnify and hold Nomad AI Systems harmless from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party.

15. Suspension and termination

We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. You may stop using the Service and delete your account at any time. On termination, your right to use the Service ends; sections that by their nature should survive (including content licence, disclaimers, liability limits, and indemnity) will survive. Deletion of personal information follows our Privacy Policy and Data Rights process.

16. Changes to the Service and Terms

We may update the Service and these Terms from time to time. Material changes will be posted here with an updated date and, where appropriate, notified to you. Continuing to use the Service after changes take effect means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of that jurisdiction. If any provision is found unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and us regarding the Service.
